A Consideration on Public Rights and Freedoms Discourse

Abstract

The public rights and freedoms are among the most important fundamental human rights that have gone beyond the boundaries of national legislation and taken form of transnational and universal law in such a way that special attention has been paid them in Universal Declaration of Human Rights, The International Covenant on Civil and Political Rights and The International Covenant on Economic, Social and Cultural Rights and other global and regional instruments. For this reason, the international institutions expectations in the current time are that the used principles in the Universal Declaration of Human Rights, the Covenants and other documents related to civil and human rights should become the states’ legislators guide and the way of rulers’ approaches and be respected by the governments. The constitution has the mission of protecting the rights and freedoms of citizens against the ruling power and regulation their relationship in the form of legal norms in such a way that it is considered as one the principal constituent corners of Islamic Republic of Iran regime foundation beside  ‘’Independence’’ and ‘’ The Islamic Republic’’. Constitutional legislator has taken into consideration a variety of citizenship rights and freedoms in codifying the constitution in order to preserve human dignity and value it. In this article, we have tried to discuss citizens’ rights and freedoms beside analyzing and describing them in several international documents and constitution of Islamic of Republic of Iran.
